Article R342-13 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The first president of the court of appeal or his delegate shall rule on the request to declare the appeal suspensive, after the foreign national or his counsel has been given the opportunity to submit his observations, in accordance with the procedures defined in article R. 342-10.
The decision of the first president or his delegate on the suspensive nature of the appeal is brought to the attention of the foreign national and his counsel by the registry of the court of appeal and communicated to the public prosecutor, who ensures that it is carried out and informs the administrative authority.

Le premier président de la cour d’appel ou son délégué statue sur la demande visant à déclarer l’appel suspensif, après que l’étranger ou son conseil a été mis à même de transmettre ses observations, suivant les modalités définies à l’article R. 342-10.
La décision du premier président ou de son délégué sur le caractère suspensif de l’appel est portée à la connaissance de l’étranger et de son conseil par le greffe de la cour d’appel et communiquée au procureur de la République, qui veille à son exécution et en informe l’autorité administrative.
