Article R3512-10 of the French Public Health Code

Suspicion of the presence of a characterising flavour in a tobacco product may be reported to the Minister for Health by any natural or legal person. The Minister for Health asks manufacturers and importers to inform him of their assessment of the product concerned.

When the Minister for Health considers, after investigation, that a product contains a characterising flavour, he informs the manufacturers and importers and gives them the opportunity to submit written observations.

Pursuant to 1° of I of article L. 3512-16, the Minister for Health issues an order prohibiting the reference of tobacco products containing a characterising flavour. This decision is notified to the manufacturers and importers of the tobacco products concerned.

La suspicion de la présence d’un arôme caractérisant dans un produit du tabac peut être signalée au ministre chargé de la santé par toute personne physique ou morale. Le ministre chargé de la santé demande aux fabricants et importateurs de lui faire part de leur évaluation du produit concerné.

Lorsque le ministre chargé de la santé estime, après enquête, qu’un produit contient un arôme caractérisant, il en informe les fabricants et importateurs et leur donne la possibilité de présenter des observations écrites.

En application du 1° du I de l’article L. 3512-16, le ministre chargé de la santé interdit par arrêté la référence de produit du tabac contenant un arôme caractérisant. Cette décision est notifiée aux fabricants et aux importateurs des produits du tabac concernés.
