Article R3512-11 of the French Public Health Code

I.-The declaration mentioned in I of Article L. 3512-17 includes the following information:

1° The reasons for the presence of the ingredients in the product;

2° The exact quantity, in descending order by weight, of each ingredient included in the product;

3° The levels of tar, nicotine and carbon monoxide emissions;

4° Where available, information on other emissions, their levels and the measurement methods used;

5° The relevant toxicological data for these ingredients, with and without combustion, as appropriate. These data shall be specified for all stages of manufacture of tobacco products. They include the toxicity of these ingredients, i.e. the extent to which a substance can produce harmful effects on the human body, including effects appearing over time as a result of repeated or continuous consumption or exposure;

6° Data concerning the effects on consumer health, taking account of addictive properties.

The elements mentioned in 5° and 6° are accompanied by a summary of the analysis methods used and their results and are transmitted in accordance with a common declaration format.

II-Any change in the composition of the product which has an impact on the information communicated shall be the subject of an amending declaration before the modified product is placed on the market.

Article R3512-11

I.-La déclaration mentionnée au I de l’article L. 3512-17 comprend les éléments suivants :

1° Les raisons de la présence des ingrédients dans le produit ;

2° La quantité exacte établie par ordre décroissant du poids de chaque ingrédient inclus dans le produit ;

3° Les niveaux d’émissions de goudron, de nicotine et de monoxyde de carbone ;

4° Lorsque ces données sont disponibles, les informations sur d’autres émissions, leurs niveaux et les méthodes de mesure employées ;

5° Les données toxicologiques pertinentes pour ces ingrédients, avec et sans combustion, selon le cas. Ces données sont précisées pour toutes les étapes de fabrication des produits du tabac. Elles comprennent la toxicité de ces ingrédients, c’est-à-dire la mesure dans laquelle une substance peut produire des effets nocifs sur l’organisme humain, y compris des effets apparaissant dans la durée en raison d’une consommation ou d’une exposition répétée ou continue ;

6° Les données concernant les effets sur la santé des consommateurs en tenant compte des propriétés créant une dépendance.

Les éléments mentionnés au 5° et au 6° sont accompagnés du résumé des méthodes d’analyse utilisées et de leurs résultats et sont transmis conformément à un format commun de déclaration.

II.-Toute modification dans la composition du produit qui a une répercussion sur l’information communiquée fait l’objet d’une déclaration modificative avant la mise sur le marché du produit modifié.
