Article R3512-13 of the French Public Health Code

I.-The notification referred to in III of article L. 3512-17 includes the following information:

1° A detailed description of the product and instructions for its use;

2° The information on the ingredients and emission levels of the product referred to in 2°, 3° and 4° of article R. 3512-11;

3° Available scientific studies on the toxicity, addictiveness and attractiveness of the new tobacco product, in particular with regard to its ingredients and emissions;

4° Available studies, their summaries and market analyses concerning the preferences of different consumer groups;

5° Any useful new or updated information available, in particular a risk/benefit analysis of the product, its expected effects on cessation of tobacco consumption, its expected effects on initiation of tobacco consumption and forecasts of consumer perceptions.

II -Any new or updated information is the subject of an amending notification.

III-The public establishment mentioned in I of Article L. 3512-17 may request additional information or tests from manufacturers and importers concerning new tobacco products.

This request does not affect the deadline mentioned in III of article L. 3512-17.

Article R3512-13

I.-La notification mentionnée au III de l’article L. 3512-17 comprend les éléments suivants :

1° La description détaillée du produit et les instructions pour son utilisation ;

2° Les informations relatives aux ingrédients et aux niveaux d’émissions du produit mentionnées aux 2°, 3° et 4° de l’article R. 3512-11 ;

3° Les études scientifiques disponibles sur la toxicité, l’effet de dépendance et l’attractivité du nouveau produit du tabac, en particulier du point de vue de ses ingrédients et de ses émissions ;

4° Les études disponibles, leur synthèse et les analyses de marché au sujet des préférences des différents groupes de consommateurs ;

5° Toute information utile disponible, nouvelle ou actualisée, notamment une analyse risques/ bénéfices du produit, ses effets attendus sur l’arrêt de la consommation de tabac, ses effets attendus sur l’initiation à la consommation de tabac ainsi que des prévisions concernant la perception des consommateurs.

II.-Toute information nouvelle ou actualisée fait l’objet d’une notification modificative.

III.-L’établissement public mentionné au I de l’article L. 3512-17 peut demander des informations ou des essais complémentaires aux fabricants et importateurs concernant les nouveaux produits du tabac.

Cette demande est sans incidence sur le délai mentionné au III de l’article L. 3512-17.
