Article R4002-5 of the French Public Health Code

In the case of an application for partial access for the purpose of establishing or providing a service, the competent authority shall refuse to issue the authorisation requested if it considers that one of the conditions laid down in I of article L. 4002-3 has not been met or if this refusal is justified on one of the grounds mentioned in II of the same article, in the light in particular of the opinions issued under the conditions defined in article R. 4002-2.

En cas de demande d’accès partiel à fin d’établissement ou de prestation de service, l’autorité compétente refuse de délivrer l’autorisation sollicitée lorsqu’elle estime que l’une des conditions fixées au I de l’article L. 4002-3 n’est pas remplie ou lorsque que ce refus est justifié par un des motifs mentionnés au II du même article, au vu notamment des avis rendus dans les conditions définies à l’article R. 4002-2.
