Article R411-19 of the French Tourism Code

The Agency is subject to the provisions of Titles I and III of Decree no. 2012-1246 of 7 November 2012 on public budgetary and accounting management, with the exception of 1° and 2° of article 175, articles 178 to 185, 204 to 208 and 220 to 228 as well as the State’s economic and financial control as defined by Decree no. 53-707 of 9 August 1953 as amended relating to State control over national public companies and certain bodies with an economic or social purpose and Decree no. 55-733 of 26 May 1955 as amended relating to the State’s economic and financial control.

The powers of the authority responsible for State economic and financial control and the procedures for exercising its control are specified as necessary by joint order of the Minister for Tourism and the Minister for the Budget.

This authority has the same powers in the companies over which the agency acquires control.

The accounting officer is appointed by order of the Minister for the Budget.

L’agence est soumise aux dispositions des titres Ier et III du décret n° 2012-1246 du 7 novembre 2012 relatif à la gestion budgétaire et comptable publique à l’exception des 1° et 2° de l’article 175, des articles 178 à 185, 204 à 208 et 220 à 228 ainsi qu’au contrôle économique et financier de l’Etat tel que défini par le décret n° 53-707 du 9 août 1953 modifié relatif au contrôle de l’Etat sur les entreprises publiques nationales et certains organismes ayant un objet d’ordre économique ou social et le décret n° 55-733 du 26 mai 1955 modifié relatif au contrôle économique et financier de l’Etat.

Les attributions de l’autorité chargée du contrôle économique et financier de l’Etat et les modalités d’exercice de son contrôle sont précisées en tant que de besoin par arrêté conjoint du ministre chargé du tourisme et du ministre chargé du budget.

Cette autorité dispose des mêmes pouvoirs dans les sociétés dont l’agence acquiert le contrôle.

L’agent comptable est nommé par arrêté du ministre chargé du budget.
