Article R4111-14 of the French Public Health Code

The Director General of the Centre national de gestion, on behalf of the Minister for Health, shall, after obtaining the opinion of the commission provided for in article R. 4111-15, issue the authorisation to practise provided for in Ia and II of article L. 4111-2 and in articles L. 4131-1-1, L. 4141-3-1 and L. 4151-5-1, on the basis of an application accompanied by a file compiled in accordance with the procedures laid down by order of the Minister for Health.

The files are sent to the national management centre, which acknowledges receipt of the application within one month of its receipt and, where applicable, informs the applicant within the same period of the missing documents and information.

Silence kept by the competent authority for six months on applications submitted in application of Ia of article L. 4111-2 and for four months on those submitted in application of II of article L. 4111-2, articles L. 4131-1-1, L. 4141-3 and L. 4151-5 from receipt of a complete application shall be deemed to constitute a decision to reject the application.

Article R4111-14

Le directeur général du Centre national de gestion, au nom du ministre chargé de la santé, délivre, après avis de la commission prévue à l’article R. 4111-15, l’autorisation d’exercice prévue au I bis et au II de l’article L. 4111-2 et aux articles L. 4131-1-1, L. 4141-3-1 et L. 4151-5-1, au vu d’une demande accompagnée d’un dossier composé selon des modalités fixées par arrêté du ministre chargé de la santé.

Les dossiers sont adressés au centre national de gestion qui accuse réception de la demande dans le délai d’un mois à compter de sa réception et le cas échéant, indique au demandeur dans ce même délai les pièces et informations manquantes.

Le silence gardé par l’autorité compétente pendant six mois sur les demandes présentées en application du I bis de l’article L. 4111-2 et pendant quatre mois sur celles présentées en application du II de l’article L. 4111-2, des articles L. 4131-1-1, L. 4141-3 et L. 4151-5 à compter de la réception d’un dossier complet vaut décision de rejet de la demande.
