The Director General of the Centre National de Gestion, on behalf of the Minister for Health, terminates the temporary authorisation to practise medicine or dental surgery in the event of:
1° Termination of the bilateral agreement or cooperation agreement mentioned in 2° of article L. 4111-1-2, on the effective date of the termination ;
2° Termination of the agreement to host the practitioner by the director of the host health establishment, on the effective date of termination;
3° If the practitioner abandons his training or hospital duties.
It may also terminate the contract if the performance of duties by the host practitioner presents a risk to public health.
Except in the cases mentioned in 1° and 2°, the decision of the Director General of the Centre National de Gestion may only be taken after the practitioner has been given the opportunity to submit written observations and, where appropriate, at his request, oral observations. The person concerned may be assisted by counsel or represented by an agent of his choice.
The decision of the Director General of the National Management Centre terminating the temporary authorisation to practise medicine or dental surgery entails the termination of the hosting agreement. The relevant Conseil national de l’ordre is informed.
