Article R4123-19 of the French Public Health Code

As soon as a complaint is received, the Chairman of the Conseil départemental appoints one or more conciliators from among the members of the commission and informs the parties of this in the summons sent to them within one month, in accordance with article L. 4123-2.

Members of the conciliation commission who are directly or indirectly implicated by a complaint may not be appointed as conciliators for that complaint, nor may they take part in the vote when the complaint is examined by the departmental council with a view to its referral to the disciplinary court.

Dès réception d’une plainte, le président du conseil départemental désigne parmi les membres de la commission un ou plusieurs conciliateurs et en informe les parties dans la convocation qui leur est adressée dans le délai d’un mois, conformément à l’article L. 4123-2.

Les membres de la commission de conciliation mis en cause directement ou indirectement par une plainte ne peuvent ni être désignés en tant que conciliateurs pour cette plainte ni prendre part au vote lors de l’examen de la plainte par le conseil départemental en vue de sa transmission à la juridiction disciplinaire.
