Article R4126-44 of the French Public Health Code

The time limit for appeal is thirty days from notification of the decision.

Additional time limits for distance are added to the time limit provided for in the previous paragraph, in accordance with the provisions of articles 643 and 644 of the Code of Civil Procedure.

Failure to mention the thirty-day time limit for appeal in the notification of the decision of the Disciplinary Chamber of First Instance shall result in the application of the two-month time limit.

If the notification is returned to the clerk’s office with the words “envelope notified and not collected” or “envelope refused and not collected”, the appeal is admissible within the thirty-day period following the date of presentation of the registered letter.

If the notification is returned to the court clerk’s office with the words “addressee unknown at address”, the appeal is admissible within thirty days of the date of the postmark.

Le délai d’appel est de trente jours à compter de la notification de la décision.

Les délais supplémentaires de distance s’ajoutent au délai prévu à l’alinéa précédent, conformément aux dispositions des articles 643 et 644 du code de procédure civile.

Le défaut de mention, dans la notification de la décision de la chambre disciplinaire de première instance, du délai d’appel de trente jours emporte application du délai de deux mois.

Si la notification est revenue au greffe avec la mention “ pli avisé et non réclamé ” ou “ pli refusé et non réclamé ”, l’appel est recevable dans le délai de trente jours qui suit la date de présentation de la lettre recommandée.

Si la notification est revenue au greffe avec la mention “ destinataire inconnu à l’adresse ”, l’appel est recevable dans le délai de trente jours qui suit la date du cachet de la poste.
