Article R413-13 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When the foreign national obtains results in the test referred to in article R. 413-9 that are equal to or higher than the level determined by the order referred to in the same article and attesting to a satisfactory level of mastery of the French language as provided for in article L. 413-6, or if he/she provides proof of mastery of this level by producing diplomas or tests as provided for by the same order, he/she is exempted by the French Office for Immigration and Integration from enrolling in language training. This is mentioned in the republican integration contract.
If the foreign national obtains results in this test that are below the level determined by the order mentioned in the first paragraph, language training is prescribed and this is mentioned in the republican integration contract.
The training will be terminated early if the foreign national reaches the target language level in an intermediate assessment test and has attended the training course regularly.

At the end of the training, the foreign national will be informed of the results.
At the end of the course, the training organisation will provide the foreign national, on request, with a certificate of attendance stating the number of hours completed and the results obtained in the initial and final assessment tests.

If the foreign national obtains results in the test referred to in article R. 413-9 that are higher than the level determined by the order referred to in the same article, or if it is established during the intermediate assessment or at the end of the course that he/she has reached the target language level, he/she will be offered the opportunity to have his/her level of French certified. The cost of this certification is borne by the State.

An order by the minister responsible for reception and integration sets the maximum duration of the prescribed language training and specifies the conditions under which it is organised and its content, as well as the time limit within which certification of their language level may be requested by the foreign national and the arrangements for this certification to be paid for by the State.

Lorsque l’étranger obtient au test mentionné à l’article R. 413-9 des résultats égaux ou supérieurs au niveau déterminé par l’arrêté mentionné au même article et attestant du niveau satisfaisant de maîtrise de la langue française prévu par l’article L. 413-6, ou s’il justifie de la maîtrise de ce niveau par la production de diplômes ou de tests prévus par le même arrêté, il est dispensé par l’Office français de l’immigration et de l’intégration de l’inscription à la formation linguistique. Il en est fait mention dans le contrat d’intégration républicaine.

Lorsque l’étranger obtient à ce test des résultats inférieurs au niveau déterminé par l’arrêté mentionné au premier alinéa, une formation linguistique lui est prescrite dont il est fait mention dans le contrat d’intégration républicaine.

Il est mis un terme anticipé à la formation lorsque l’étranger atteint le niveau linguistique ciblé lors d’un test d’évaluation intermédiaire et qu’il a suivi sa formation avec assiduité.

A l’issue de la formation, l’organisme de formation remet à l’étranger, sur demande, une attestation nominative de présence mentionnant le nombre d’heures réalisées et les résultats obtenus aux tests d’évaluation initial et final.

Lorsque l’étranger obtient au test mentionné à l’article R. 413-9 des résultats supérieurs au niveau déterminé par l’arrêté mentionné au même article, ou qu’il est constaté lors de l’évaluation intermédiaire ou au terme de sa formation qu’il a atteint le niveau linguistique visé, il lui est proposé de faire certifier son niveau de français. Les frais de cette certification sont à la charge de l’Etat.

Un arrêté du ministre chargé de l’accueil et de l’intégration fixe la durée maximale de la formation linguistique prescrite et précise les conditions dans lesquelles elle est organisée et son contenu, ainsi que le délai dans lequel la certification de son niveau de langue peut être demandée par l’étranger et les modalités de la prise en charge par l’Etat de cette certification.
