Article R421-50 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When the foreign national applying for a multi-annual residence permit bearing the words “mobile ICT employee (family)” as provided for in article L. 421-28 resides outside France, the decision to issue the residence permit applied for is taken by the diplomatic or consular authority. The residence permit is issued to the foreign national by the Prefect of the département in which the foreign national has established residence in France or, in Paris, by the Police Prefect, upon presentation of the passport bearing a long-stay visa marked “salarié détaché ICT (famille)”.
When the foreign national is already admitted to reside on French territory, the decision to issue the residence permit applied for is taken by the prefect of his/her place of residence or, in Paris, by the police prefect.

Lorsque l’étranger, qui sollicite la délivrance de la carte de séjour pluriannuelle portant la mention ” salarié détaché mobile ICT (famille) ” prévue à l’article L. 421-28 réside hors de France, la décision de délivrance du titre de séjour sollicitée est prise par l’autorité diplomatique et consulaire. La carte de séjour est remise à l’étranger par le préfet du département où l’étranger a établi sa résidence en France ou, à Paris, par le préfet de police, sur présentation de son passeport revêtu d’un visa de long séjour portant la mention ” salarié détaché ICT (famille) “.
Lorsque l’étranger est déjà admis au séjour sur le territoire français, la décision de délivrance du titre de séjour sollicitée est prise par le préfet de son lieu de résidence ou, à Paris, par le préfet de police.
