Article R421-55 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The issue of a temporary residence permit bearing the wording “ICT trainee” provided for in article L. 421-30 or that of a temporary residence permit bearing the wording “ICT mobile trainee” provided for in article L. 421-31 is refused in the following situations:
1° The foreign national is carrying out an assignment in an establishment or company that was set up with the main aim of facilitating the entry into France of foreign nationals falling within the scope of articles L. 421-30 and L. 421-31;
2° The employer, or the company hosting the foreign national, has been convicted under article L. 8256-1 of the Labour Code;
3° The maximum duration of stay of one year has been reached, reduced where applicable by the duration of stay completed in another Member State of the European Union in connection with a similar assignment.

La délivrance de la carte de séjour temporaire portant la mention ” stagiaire ICT ” prévue à l’article L. 421-30 ou celle de la carte de séjour temporaire portant la mention ” stagiaire mobile ICT ” prévue à l’article L. 421-31 est refusée dans les situations suivantes :
1° L’étranger effectue une mission dans un établissement ou une entreprise qui a été créée dans le but principal de faciliter l’entrée en France d’étrangers entrant dans les prévisions des articles L. 421-30 et L. 421-31 ;
2° L’employeur, ou l’entreprise d’accueil de l’étranger a été condamné en vertu de l’article L. 8256-1 du code du travail ;
3° La durée maximale de séjour d’un an est atteinte, réduite le cas échéant de la durée de séjour effectuée dans un autre Etat membre de l’Union européenne dans le cadre d’une mission similaire.
