Article R421-56 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The issue of a temporary residence permit bearing the wording “ICT trainee” provided for in article L. 421-30 or that of a temporary residence permit bearing the wording “ICT mobile trainee” provided for in article L. 421-31 may be refused in the following situations:
1° The employer, establishment or host company has been sanctioned for failing to comply with the prohibitions defined in 1° to 4° of article L. 8211-1 of the Labour Code;
2° The employer, establishment or host company has been convicted under article L. 8256-2 of the same code;
3° The employer, establishment or host company has failed to comply with its legal obligations in terms of social security, taxation or employment rights or working conditions.

La délivrance de la carte de séjour temporaire portant la mention ” stagiaire ICT ” prévue à l’article L. 421-30 ou celle de la carte de séjour temporaire portant la mention ” stagiaire mobile ICT ” prévue à l’article L. 421-31 peut être refusée dans les situations suivantes :
1° L’employeur, l’établissement ou l’entreprise d’accueil a été sanctionné pour avoir méconnu les interdictions définies aux 1° à 4° de l’article L. 8211-1 du code du travail ;
2° L’employeur, l’établissement ou l’entreprise d’accueil a été condamné en vertu de l’article L. 8256-2 du même code ;
3° L’employeur, l’établissement ou l’entreprise d’accueil a manqué à ses obligations légales en matière de sécurité sociale, de fiscalité ou de droits en matière de travail ou de conditions de travail.
