Article R422-55-5 of the French Intellectual Property Code

Within thirty days of the end of the physical inspection operations, the inspector(s) will send a provisional report to the person who was the subject of the inspection.

The latter will have a period of thirty days in which to make written observations on the content of the report.

At the end of this period, the examiner(s) will draw up a final report, to which they will attach the written observations of the person concerned if they have produced any, and will send this report to the President of the Compagnie nationale des conseils en propriété industrielle and to the Director General of the Institut national de la propriété industrielle. The report does not include any information covered by the professional secrecy of the various professionals practising within the company.

Dans les trente jours suivant la fin des opérations matérielles de contrôle, le ou les contrôleurs adressent à la personne qui en a fait l’objet un rapport provisoire.

Cette dernière dispose d’un délai de trente jours pour former ses observations écrites sur le contenu du rapport.

A l’issue de ce délai, le ou les contrôleurs établissent un rapport définitif, auquel ils annexent les observations écrites de la personne concernée si elle en a produites, et adresse ce rapport au président de la Compagnie nationale des conseils en propriété industrielle et au directeur général de l’Institut national de la propriété industrielle. Le rapport ne comporte aucune information couverte par le secret professionnel des différents professionnels exerçant au sein de la société.
