Article R422-58 of the French Intellectual Property Code

The matter is referred to the Disciplinary Board by the Keeper of the Seals, Minister of Justice, by the Minister responsible for industrial property, by the Director General of the National Institute of Industrial Property, by the President of the National Association of Industrial Property Attorneys or by the complaint of a person who considers himself to have been harmed by the failure of an industrial property attorney to fulfil his obligations.

The referral or complaint shall be sent for the attention of the president of the Disciplinary Board, to the address of the secretariat of the Disciplinary Board at the headquarters of the Institut national de la propriété industrielle. The act of referral is notified to the industrial property agent concerned. The secretariat shall send a copy of the act of referral to the president of the Compagnie nationale des conseils en propriété industrielle.

La chambre de discipline est saisie par le garde des sceaux, ministre de la justice, par le ministre chargé de la propriété industrielle, par le directeur général de l’Institut national de la propriété industrielle, par le président de la Compagnie nationale des conseils en propriété industrielle ou par la plainte d’une personne s’estimant lésée par le manquement d’un conseil en propriété industrielle à ses obligations.

La saisine ou la plainte sont envoyées à l’attention du président de la chambre de discipline, à l’adresse du secrétariat de la chambre de discipline au siège de l’Institut national de la propriété industrielle. L’acte de saisine est notifié au conseil en propriété industrielle concerné. Le secrétariat transmet une copie de l’acte de saisine au président de la Compagnie nationale des conseils en propriété industrielle.
