I.-Application for a European professional card, accompanied by supporting documents, is submitted by a pharmacist to the competent authority of a Member State of the European Union or party to the Agreement on the European Economic Area, with a view to practising the profession of pharmacist in France or providing services there. The competent authority of the applicant’s country of origin, whether a Member State or a party to the Agreement on the European Economic Area, sends the application electronically to the regional directorate mentioned in the first paragraph of article R. 4222-9.
II.The regional directorate referred to in the first paragraph of article R. 4222-9, which receives a pharmacist’s application for a European professional card from a competent authority in a Member or Partial Member State, together with the necessary supporting documents, sends the individual electronic file created in the internal market information system:
1° Or, where the provisions of articles L. 4221-4 and L. 4221-5 are applicable, to the conseil national de l’ordre, with a view to issuing the card within one month of receipt of the application;
2° Or, where the pharmacist wishes to provide a service and his training qualification does not meet the conditions laid down in articles L. 4221-4 and L. 4221-5, to the Conseil national de l’ordre, which may, where appropriate, subject the person concerned to an aptitude test within two months of receipt of the application;
3° Or, in the case of an application to practise the profession in France, where the pharmacist’s evidence of formal qualifications does not meet the conditions laid down in articles L. 4221-4 and L. 4221-5, to the Centre national de gestion, which may, if necessary, subject the person concerned to a compensatory measure within two months of receipt of the application.
The Conseil national de l’ordre or the Centre national de gestion may request additional information from the applicant’s Member State or State of origin.
They may refuse to issue the card if they do not receive the information required to examine the application. Reasons shall be given for any such refusal.
III – The time limits stipulated in points 1 to 3 of II may be extended for a period of fifteen days, renewable once, on public health grounds. Reasons are given for the extension decision and the applicant is notified.
In the absence of a decision within the time limits laid down in 1° to 3° of II, the European professional card is deemed to have been issued and sent electronically to the pharmacist.
