Article R4222-3 of the French Public Health Code

The application must be accompanied by :

1° Where it is submitted with a view to practising as a dispensary holder :

a) a copy of the licence referred to in article L. 5125-4 ;

b) a copy of any document proving that the premises on which the pharmacy is to be set up are freely available;

c) Except in the case of the creation of a pharmacy, a copy of the deed of transfer of all or part of the pharmacy free of charge or for consideration, subject to the condition precedent of registration of the declaration provided for in article L. 5125-16 or, in the case of succession, a copy of the deed of partition;

d) Any document proving that the conditions set out in article L. 5125-9 have been met;

e) A copy of the articles of association, where a company has been formed to operate a pharmacy;

2° When it is submitted with a view to practising as a pharmacist in charge, delegate, interim manager or interim delegate of a company or organisation mentioned in article R. 5124-2 or article R. 5142-1 :

a) Proof that the person concerned satisfies the conditions of practice laid down, depending on the case, in articles R. 5124-16 to R. 5124-18 or R. 5142-16 to R. 5142-18 ;

b) Where the establishment is owned by a company, a copy of the deed of the competent corporate body appointing the person concerned and setting out his or her duties;

3° If the application is submitted with a view to carrying out another professional activity as a pharmacist, any documents specifying the nature, terms and conditions of the said activity;

4° Where it is submitted with a view to registering a private practice company, in addition to the documents mentioned in 1° :

a) a copy of the company’s articles of association and by-laws ;

b) A list of the partners, indicating, for each of them, his status as a practising professional and, where applicable, his status as an assistant, or the category of persons in respect of whom he is a partner;

c) An indication of how the capital is divided between the members.

Article R4222-3

La demande est accompagnée :

1° Lorsqu’elle est présentée en vue d’exercer en qualité de titulaire d’officine :

a) De la copie de la licence prévue à l’article L. 5125-4 ;

b) De la copie de toute pièce justifiant de la libre disposition des locaux destinés à l’implantation de l’officine ;

c) Sauf en cas de création d’une officine, de la copie de l’acte de cession à titre gratuit ou onéreux de tout ou partie de l’officine sous condition suspensive de l’enregistrement de la déclaration prévue à l’article L. 5125-16 ou, en cas de succession, de la copie de l’acte de partage ;

d) De tout document justifiant que sont remplies les conditions mentionnées à l’article L. 5125-9 ;

e) La production de la copie des statuts, lorsqu’il est constitué une société en vue de l’exploitation d’une officine ;

2° Lorsqu’elle est présentée en vue d’exercer en qualité de pharmacien responsable, délégué, responsable intérimaire ou délégué intérimaire d’une entreprise ou d’un organisme mentionné à l’article R. 5124-2 ou à l’article R. 5142-1 :

a) De la justification que l’intéressé satisfait aux conditions d’exercice prévues, selon le cas, aux articles R. 5124-16 à R. 5124-18 ou R. 5142-16 à R. 5142-18 ;

b) Lorsque l’établissement est la propriété d’une société, de la copie de l’acte de l’organe social compétent portant désignation de l’intéressé et fixant ses attributions ;

3° Lorsqu’elle est présentée en vue d’exercer une autre activité professionnelle de pharmacien, de toutes pièces précisant la nature, les conditions et modalités d’exercice de ladite activité ;

4° Lorsqu’elle vise à l’inscription d’une société d’exercice libéral, outre les pièces mentionnées au 1° :

a) De la copie des statuts de la société et de son règlement intérieur ;

b) De la liste des associés, mentionnant, pour chacun d’eux, sa qualité de professionnel en exercice et, le cas échéant sa qualité d’adjoint, ou la catégorie de personnes au titre de laquelle il est associé ;

c) De l’indication de la répartition du capital entre les associés.
