Article R4222-9 of the French Public Health Code

A pharmacist wishing to obtain a European professional card pursuant to Article L. 4002-2 submits his application electronically, together with supporting documents, to a regional directorate for youth, sport and social cohesion designated by order of the Minister for Health. The latter sends the individual electronic file, created in the internal market information system referred to in II of Article 1 of Order No 2016-1809 of 22 December 2016 on the recognition of professional qualifications of regulated professions, to the national council of the professional body. The conseil national de l’ordre shall acknowledge receipt within one week and, where appropriate, inform the applicant of any missing documents.

Within one month of acknowledgement of receipt of the complete application or receipt of the missing documents, the conseil national de l’ordre will check that the applicant is legally established in France and that the supporting documents are valid.

In the event of serious doubt, the conseil national de l’ordre may contact the relevant French bodies or the competent authorities of other States, whether members of the European Union or parties to the European Economic Area, so that they can authenticate the documents concerned.

In the event that the pharmacist wishes to establish himself or provide services in another State, whether a member or a party to the European Economic Area, the national council of the professional body will forward the complete application, without delay and by electronic means, to the competent authority of that State. It will simultaneously inform the pharmacist of this transmission.

If the pharmacist’s host Member State or Party requests additional information, the competent French authority will respond within fifteen days of the request at the latest.

Un pharmacien qui souhaite obtenir une carte professionnelle européenne en application de l’article L. 4002-2 dépose, par voie électronique, sa demande, accompagnée des pièces justificatives, auprès d’une direction régionale de la jeunesse, des sports et de la cohésion sociale désignée par arrêté du ministre chargé de la santé. Celle-ci transmet le dossier électronique individuel, créé dans le système d’information du marché intérieur mentionné au II de l’article 1er de l’ordonnance n° 2016-1809 du 22 décembre 2016 relative à la reconnaissance des qualifications professionnelles de professions réglementées, au conseil national de l’ordre. Le conseil national de l’ordre en accuse réception dans un délai d’une semaine et, le cas échéant, informe le demandeur de tout document manquant.

Dans un délai d’un mois à compter de l’accusé de réception du dossier complet ou de la réception des documents manquants, le conseil national de l’ordre vérifie que le demandeur est légalement établi en France et que les pièces justificatives sont valides.

En cas de doute sérieux, le conseil national de l’ordre peut s’adresser aux organismes français concernés ou aux autorités compétentes des autres Etats, membres de l’Union européenne ou parties à l’Espace économique européen, pour qu’elles authentifient les pièces concernées.

Dans le cas où le pharmacien souhaite s’établir ou effectuer une prestation de services dans un autre Etat, membre ou partie, le conseil national de l’ordre transmet le dossier complet, sans délai et par voie électronique, à l’autorité compétente de cet Etat. Il informe simultanément le pharmacien de cette transmission.

Lorsque l’Etat, membre ou partie, d’accueil du pharmacien sollicite des informations complémentaires, l’autorité compétente française répond au plus tard dans les quinze jours qui suivent la demande.
