In establishments with fewer than fifty employees, the employer shall provide them with a place to eat in good health and safety conditions.
The number of employees and the fact that the threshold of fifty employees has been crossed are determined in accordance with the procedures set out in article L. 130-1 of the Social Security Code. When the company has several establishments, the number of employees is calculated for each establishment.
By way of derogation from article R. 4228-19, the location mentioned in the first paragraph may, after a declaration has been sent to the labour inspector and the occupational physician by any means giving a date certain, be set up in the premises assigned to work, provided that the activity of these premises does not involve the use or storage of dangerous substances or mixtures.
A joint order by the Ministers of Labour and Agriculture defines the content of the aforementioned declaration.
