Article R4235-55 of the French Public Health Code

The organisation of the pharmacy or the pharmacy for internal use must ensure the quality of all the procedures carried out there.

The pharmacist must ensure that the public does not have direct access to medicines and that these are dispensed with the discretion required by professional secrecy.

However, the pharmacist in charge or the pharmacist managing a dispensary may make the prescription medicines mentioned in article R. 5121-202 directly accessible to the public. These medicinal products must be presented in a dedicated area, clearly identified and located in the immediate vicinity of the dispensing stations for medicinal products and the pharmacy record mentioned in article L. 161-36-4-2 of the Social Security Code, in such a way as to allow effective control by the pharmacist. The latter makes available to the public information from the health authorities relating to the proper use of prescription medicines.

L’organisation de l’officine ou de la pharmacie à usage intérieur doit assurer la qualité de tous les actes qui y sont pratiqués.

Le pharmacien veille à ce que le public ne puisse accéder directement aux médicaments et à ce que ceux-ci soient dispensés avec la discrétion que requiert le respect du secret professionnel.

Toutefois, le pharmacien titulaire ou le pharmacien gérant une officine peut rendre directement accessibles au public les médicaments de médication officinale mentionnés à l’article R. 5121-202. Ces médicaments doivent être présentés dans un espace dédié, clairement identifié et situé à proximité immédiate des postes de dispensation des médicaments et d’alimentation du dossier pharmaceutique mentionné à l’article L. 161-36-4-2 du code de la sécurité sociale, de façon à permettre un contrôle effectif du pharmacien. Ce dernier met à la disposition du public les informations émanant des autorités de santé relatives au bon usage des médicaments de médication officinale.
