Article R431-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Application for a residence permit appearing on a list set by order of the minister responsible for immigration is made using a teleservice from the date set by the same order. The categories of residence permits designated by decree are listed in Annex 9 to this code.

People who are unable to submit their application online themselves will be welcomed and accompanied to enable them to complete this formality.

In addition, an alternative solution, in the form of a physical reception enabling the application to be registered, will be put in place for foreign nationals who, having taken all the steps required of them, in particular having made use of the reception and support system provided for in the previous paragraph, find themselves unable to use the teleservice for reasons relating to its design or mode of operation.

The Minister responsible for immigration shall set out by decree the terms and conditions of the reception and support referred to in the second paragraph as well as the conditions of use and terms of implementation of the alternative solution provided for in the third paragraph.

Article R431-2

La demande d’un titre de séjour figurant sur une liste fixée par arrêté du ministre chargé de l’immigration s’effectue au moyen d’un téléservice à compter de la date fixée par le même arrêté. Les catégories de titres de séjour désignées par arrêté figurent en annexe 9 du présent code.

Les personnes qui ne sont pas en mesure d’effectuer elles-mêmes le dépôt en ligne de leur demande bénéficient d’un accueil et d’un accompagnement leur permettant d’accomplir cette formalité.

En outre, une solution de substitution, prenant la forme d’un accueil physique permettant l’enregistrement de la demande, est mise en place pour l’étranger qui, ayant accompli toutes les diligences qui lui incombent, notamment en ayant fait appel au dispositif d’accueil et d’accompagnement prévu à l’alinéa précédent, se trouve dans l’impossibilité constatée d’utiliser le téléservice pour des raisons tenant à la conception ou au mode de fonctionnement de celui-ci.

Le ministre chargé de l’immigration fixe par arrêté les modalités de l’accueil et de l’accompagnement mentionnés au deuxième alinéa ainsi que les conditions de recours et modalités de mise en œuvre de la solution de substitution prévue au troisième alinéa.
