Article R431-8 of the French Code governing the entry and residence of foreign nationals and the right of asylum

A foreign national holding a residence document must, in the absence of an application for the issue of a new residence document six months after its expiry date, provide proof once again, in order to obtain a residence document, of the conditions required for entry into national territory when possession of a visa is required for the first issue of a residence document.

The provisions of this article do not apply to foreign nationals holding long-term resident-EU status granted by France pursuant to articles L. 421-12, L. 421-25, L. 424-5, L. 424-14 or L. 426-17.

L’étranger titulaire d’un document de séjour doit, en l’absence de présentation de demande de délivrance d’un nouveau document de séjour six mois après sa date d’expiration, justifier à nouveau, pour l’obtention d’un document de séjour, des conditions requises pour l’entrée sur le territoire national lorsque la possession d’un visa est requise pour la première délivrance d’un document de séjour.


Les dispositions du présent article ne sont pas applicables à l’étranger titulaire du statut de résident de longue durée-UE accordé par la France en application des articles L. 421-12, L. 421-25, L. 424-5, L. 424-14 ou L. 426-17.
