Article R432-7 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The administrative authority competent to refer the matter to the residence permit commission pursuant to article L. 432-13 is the Prefect or, in Paris, the Prefect of Police.
The request for an opinion is accompanied by the documents required to examine the case, including in particular the reasons which lead the Prefect to consider a decision to refuse to issue or renew a residence permit or a decision to withdraw a residence permit under the conditions defined in article L. 432-13, as well as documents proving that the foreign national applying for exceptional admission to residence on the basis of article L. 435-1 has been habitually resident in France for more than ten years.

This application must be accompanied by a copy of the application form.

L’autorité administrative compétente pour saisir la commission du titre de séjour en application de l’article L. 432-13 est le préfet ou, à Paris, le préfet de police.
La demande d’avis est accompagnée des documents nécessaires à l’examen de l’affaire, comportant notamment les motifs qui conduisent le préfet à envisager une décision de refus de délivrance ou de renouvellement d’un titre de séjour ou une décision de retrait d’un titre de séjour dans les conditions définies à l’article L. 432-13, ainsi que les pièces justifiant que l’étranger qui sollicite une admission exceptionnelle au séjour sur le fondement de l’article L. 435-1 réside habituellement en France depuis plus de dix ans.
