Article R432-8 of the French Code governing the entry and residence of foreign nationals and the right of asylum

If the residence permit commission to which the application has been duly submitted has not issued its opinion within three months of the date on which the application was registered with the prefect’s secretariat, its opinion is deemed to have been issued and the prefect may take a decision.

Si la commission du titre de séjour régulièrement saisie n’a pas émis son avis à l’issue des trois mois qui suivent la date d’enregistrement de la saisine du préfet à son secrétariat, son avis est réputé rendu et le préfet peut statuer.
