Article R432-9 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When the Prefect, who is considering refusing to issue or renew a residence permit, refers the matter to the Commission mentioned in article L. 432-14 for an opinion, he will make available to the foreign national, as soon as the matter is referred to the Commission, the certificate of extension of the examination of his application mentioned in the second paragraph of article R. 431-15-1 if the residence permit applied for is on the list referred to in article R. 431-2 or, if it is not, a receipt of application for a residence permit.

Lorsque le préfet, qui envisage de refuser la délivrance ou le renouvellement d’un titre de séjour, saisit la commission mentionnée à l’article L. 432-14 pour avis, il met à disposition de l’étranger, dès la saisine de la commission, l’attestation de prolongation de l’instruction de sa demande mentionnée au deuxième alinéa de l’article R. 431-15-1 si le titre de séjour sollicité figure dans la liste mentionnée à l’article R. 431-2 ou, s’il n’y figure pas, un récépissé de demande de titre de séjour.


Ces documents sont valables trois mois et sont renouvelés jusqu’à ce que le préfet ait statué. Ils portent la mention “ Il autorise son titulaire à travailler ” lorsque l’étranger était précédemment titulaire d’un titre de séjour l’autorisant à travailler.
