Article R4364-11 of the French Public Health Code

The representative of the State in the region shall, after obtaining the opinion of the Commission of prosthetists and orthotists for the fitting of orthopaedic devices for disabled persons provided for in article R. 4364-11-4, issue the authorisation to practise referred to in article L. 4364-5, on the basis of an application accompanied by a file presented and examined in accordance with the procedures laid down by the order referred to in article R. 4364-11-2.

It acknowledges receipt of the application within one month of its receipt and, where appropriate, informs the applicant within the same period of the missing documents and information.

If the State representative does not respond within four months of receiving the complete application, the application will be rejected.

Article R4364-11

Le représentant de l’Etat dans la région délivre, après avis de la commission des prothésistes et orthésistes pour l’appareillage des personnes handicapées prévue à l’article R. 4364-11-4, l’autorisation d’exercice mentionnée à l’article L. 4364-5, au vu d’une demande accompagnée d’un dossier présenté et instruit selon les modalités fixées par l’arrêté mentionné à l’article R. 4364-11-2.

Il accuse réception de la demande dans le délai d’un mois à compter de sa réception et le cas échéant, indique au demandeur dans ce même délai les pièces et informations manquantes.

Le silence gardé par représentant de l’Etat à l’expiration d’un délai de quatre mois à compter de la réception du dossier complet vaut décision de rejet de la demande.
