Article R4381-12 of the French Public Health Code

Approval is refused if the application does not comply with the conditions set out in article R. 4381-10 or if the articles of association do not comply with the legislative and regulatory provisions in force.

Reasons must be given for any decision to refuse registration. It is notified to each of the interested parties by registered letter with acknowledgement of receipt. It may only be made after the interested parties have been invited to present any oral or written observations.

Article R4381-12

L’agrément est refusé si la demande n’est pas conforme aux conditions énoncées à l’article R. 4381-10 ou si les statuts ne sont pas conformes aux dispositions législatives et réglementaires en vigueur.

La décision de refus d’inscription est motivée. Elle est notifiée, par lettre recommandée avec demande d’avis de réception, à chacun des intéressés. Elle ne peut être prise qu’après que les intéressés ont été appelés à présenter toutes observations orales ou écrites.
