Article R4413-2 of the French General Code of Local Authorities

The agency enters into agreements with the beneficiaries of the financial aid provided for in 2° of article R. 4413-1, setting out in particular the conditions for granting the aid, the obligations of the beneficiary and the terms of the agency’s control. In particular, the beneficiary must undertake to keep the land acquired or developed with the help of the agency as green space. Any forest acquired under these conditions by a public entity as referred to in 2° of article L. 111-1 of the Forestry Code must be subject to the forestry regime.

Article R4413-2

L’agence passe, avec les bénéficiaires des aides financières prévues au 2° de l’article R. 4413-1, des conventions fixant notamment les conditions d’octroi de l’aide, les obligations du bénéficiaire et les modalités du contrôle de l’agence. Le bénéficiaire doit, en particulier, s’engager à conserver leur affectation d’espaces verts aux terrains acquis ou aménagés avec l’aide de l’agence. Toute forêt, acquise dans ces conditions par une personne de droit public visée au 2° de l’article L. 111-1 du code forestier doit être soumise au régime forestier.
