Article R444-63 of the French Commercial code

The involvement of several notaries in the drafting or receipt of a deed does not increase the emolument, unless the deed is remunerated according to the number of hours spent.

The division of emoluments, excluding discounts, is set by the regulations drawn up pursuant to the article 4 of order no. 45-2590 of 2 November 1945 relating to the status of notaries and articles 25 and 26 of decree no. 71-942 of 26 November 1971.

The discount respectively granted by each party shall, where applicable, be deducted from the share to which it is entitled pursuant to the second paragraph.

L’intervention de plusieurs notaires dans la rédaction ou la réception d’un acte n’en augmente pas l’émolument, sauf si l’acte est rétribué en fonction du nombre d’heures passées.


Le partage des émoluments, hors remises, est fixé par les règlements établis en application de l’article 4 de l’ordonnance n° 45-2590 du 2 novembre 1945 relative au statut du notariat et des articles 25 et 26 du décret n° 71-942 du 26 novembre 1971.


La remise respectivement consentie par chaque intervenant est, le cas échéant, déduite de la part lui revenant en application du deuxième alinéa.
