Any incompatibility between the application of the requirements of this chapter and those laid down by other regulations with a view to the implementation of safety imperatives shall be the subject of a request for a derogation submitted by the employer, based on a specific analysis and accompanied by a proposal aimed at obtaining the highest possible level of worker safety through the implementation of compensatory measures. This application for a derogation is submitted to the competent administrative authority under the conditions laid down in II and III of Article R. 4462-36.
