Article R4523-6 of the French Labour Code

The identification and selection of external companies by the user company is based on the following three cumulative criteria:

1° The nature of the particular risks associated with the work and likely to affect the safety of the workers present in or near the installation, which is the overriding criterion;

2° The number of employees working or due to work, expressed as an average number of men per day present in or near the installation over a period of twelve consecutive months;

3° The duration of the work to be carried out from the date of consultation of the social and economic committee, as provided for in article R. 4523-8.

L’identification et la sélection des entreprises extérieures par l’entreprise utilisatrice s’effectuent sur la base des trois critères cumulatifs suivants :

1° La nature des risques particuliers liés à l’intervention et susceptibles de porter atteinte à la sécurité des travailleurs présents au sein ou à proximité de l’installation, qui constitue le critère prépondérant ;

2° L’importance des effectifs intervenant ou appelés à intervenir, exprimée en nombre moyen d’hommes par jour présents au sein ou à proximité de l’installation durant une période de douze mois consécutifs ;

3° La durée des interventions prévisibles à compter du jour de la consultation du comité social et économique, prévue à l’article R. 4523-8.
