Article R4623-12 of the French Labour Code

The procedure provided for in Article R. 4623-5 also applies:

1° In autonomous occupational health and prevention services, in the event of a change of sector or company in the group monitored by an occupational physician, when this change is contested by the person concerned or by the social and economic committee concerned;

2° In inter-company occupational health and prevention services:

a) In the event of a change of assignment of a company or establishment to an occupational physician, when this change is contested by the occupational physician, the employer or the social and economic committee concerned ;

b) In the event of a change of sector of an occupational physician, when this change is contested by the occupational physician, by the inter-company committee or the service’s control commission or its board of directors.

Article R4623-12

La procédure prévue à l’article R. 4623-5 s’applique également :

1° Dans les services autonomes de prévention et de santé au travail, en cas de changement de secteur ou d’entreprise du groupe suivi par un médecin du travail, lorsque ce changement est contesté par l’intéressé ou par le comité social et économique concerné ;

2° Dans les services de prévention et de santé au travail interentreprises :

a) En cas de changement d’affectation d’une entreprise ou d’un établissement à un médecin du travail, lorsque ce changement est contesté par le médecin du travail, par l’employeur ou par le comité social et économique concerné ;

b) En cas de changement de secteur d’un médecin du travail, lorsque ce changement est contesté par le médecin du travail, par le comité interentreprises ou la commission de contrôle du service ou son conseil d’administration.
