Article R4624-41-3 of the French Labour Code

Each remote visit or examination is carried out under conditions that guarantee:

1° The worker’s consent to the procedure being carried out by videotransmission;

2° Where applicable, the worker’s consent to the participation in this visit or examination of his general practitioner or a health professional of his choice and the worker’s information about the conditions, provided for in Article R. 4624-41-6, under which this participation is reimbursed by the health insurance scheme.

The worker’s prior consent is obtained by any means and recorded in his occupational health medical file.

If the worker does not consent to the visit or examination being carried out remotely, a physical consultation is scheduled as soon as possible and, where applicable, within the time limits laid down by this code for the performance of individual health monitoring procedures.

Chaque visite ou examen effectué à distance est réalisé dans des conditions garantissant :

1° Le consentement du travailleur à la réalisation de l’acte par vidéotransmission ;

2° Le cas échéant, le consentement du travailleur à ce que participe à cette visite ou à cet examen son médecin traitant ou un professionnel de santé de son choix et l’information du travailleur des conditions, prévues par l’article R. 4624-41-6, dans lesquelles cette participation est prise en charge par l’assurance maladie.

Le consentement préalable du travailleur est recueilli par tout moyen et consigné au sein de son dossier médical en santé au travail.

Si le travailleur ne consent pas à la réalisation à distance de la visite ou de l’examen, une consultation physique est programmée dans les meilleurs délais et, le cas échéant, dans les délais prévus pour l’intervention des actes de suivi individuel de l’état de santé par le présent code.
