Article R4755-2 of the French Labour Code

If the market supervisor intends to impose an administrative fine, it will inform the party concerned of the amount of the proposed fine and invite it to submit its observations within a period of one month.

On expiry of the period set and in the light of any observations made by the party concerned, it will notify its decision and issue the corresponding collection order.

The indication of the proposed fine and notification of the decision imposing the fine shall be made by any means capable of conferring a date certain.

Lorsque l’autorité de surveillance du marché à l’origine de la mesure envisage de prononcer une amende administrative, elle indique à l’intéressé le montant de l’amende envisagée et l’invite à présenter ses observations dans un délai d’un mois.

A l’expiration du délai fixé et au vu des observations éventuelles de l’intéressé, elle notifie sa décision et émet le titre de perception correspondant.

L’indication de l’amende envisagée et la notification de la décision infligeant l’amende sont effectuées par tout moyen permettant de leur conférer date certaine.
