Article R50-64 of the French Code of Criminal Procedure

The department managing the file shall proceed with the deletion of the data entered therein:

a) On expiry of the time limits laid down in Article 706-25-6 ;

b) When informed of one of the decisions mentioned in the penultimate paragraph of Article 706-25-6;

c) When informed of the person’s death;

d) When informed of a decision to erase taken pursuant to Article 706-25-12.

The department managing the file shall inform the person entered in the file of any withdrawal or deletion concerning him or her.

Article R50-64

Le service gestionnaire du fichier procède à l’effacement des données qui y sont inscrites :

a) A l’expiration des délais prévus par l’article 706-25-6 ;

b) Lorsqu’il est informé d’une des décisions mentionnées à l’avant-dernier alinéa de l’article 706-25-6 ;

c) Lorsqu’il est informé du décès de la personne ;

d) Lorsqu’il est informé d’une décision d’effacement prise en application de l’article 706-25-12.

Le service gestionnaire du fichier porte à la connaissance de la personne inscrite au fichier tout retrait ou effacement la concernant.
