Article R512-9-1 of the French Consumer Code

The provisions of Article 35 of Regulation (EU) 2017/625 of the European Parliament and of the Council of 15 March 2017 on official controls and other official activities to ensure compliance with food law, feed law, animal health and welfare rules, plant health rules and rules on plant protection products shall apply to all sampling within its scope carried out for the purposes of investigating and detecting infringements.

In application of paragraph 3 of the same Article 35, in the event of a dispute between the authorised agents and the operators on the basis of the opinion of a second expert referred to in paragraph 1, the operators may request, at their own expense, a documentary review of the initial analysis, test or diagnosis and, where appropriate, another analysis, test or diagnosis by another official laboratory.

Les dispositions de l’article 35 du règlement (UE) 2017/625 du Parlement européen et du Conseil du 15 mars 2017 concernant les contrôles officiels et les autres activités officielles servant à assurer le respect de la législation alimentaire et de la législation relative aux aliments pour animaux ainsi que des règles relatives à la santé et au bien-être des animaux, à la santé des végétaux et aux produits phytopharmaceutiques s’appliquent à tous les prélèvements d’échantillon entrant dans son champ d’application et réalisés pour la recherche et la constatation des infractions.

En application du paragraphe 3 du même article 35, en cas de différend entre les agents habilités et les opérateurs sur la base de l’avis d’un deuxième expert mentionné au paragraphe 1, les opérateurs peuvent demander, à leurs propres frais, l’examen documentaire de l’analyse, de l’essai ou du diagnostic initial et, le cas échéant, une autre analyse, un autre essai ou un autre diagnostic par un autre laboratoire officiel.
