Article R5123-10 of the French Labour Code

Degressive temporary allowance agreements guarantee their beneficiaries, for a period not exceeding two years, payment of an allowance assessed at the time of recruitment and calculated on a flat-rate basis taking into account the difference between the average net salary received over the last twelve months in respect of the last job, excluding remuneration for overtime and bonuses and allowances not in the nature of additional pay, and the net salary of the outplacement job.

Les conventions d’allocation temporaire dégressive garantissent à leurs bénéficiaires, pour une période qui ne peut excéder deux ans, le versement d’une allocation évaluée au moment de l’embauche et calculée forfaitairement en prenant en compte l’écart existant entre le salaire net moyen perçu au cours des douze derniers mois au titre du dernier emploi, à l’exclusion de la rémunération des heures supplémentaires et des primes et indemnités n’ayant pas le caractère d’un complément de salaire, et le salaire net de l’emploi de reclassement.
