I.-For the establishments, services or organisations mentioned in 1°, 2°, 3° or 4° of article R. 5126-1, with the exception of army hospitals and the Institution nationale des invalides, the application provided for in article R. 5126-27 is sent, by any means that provides a date certain upon receipt of the application, to the director general of the regional health agency with territorial jurisdiction.
The authorisation is issued by the latter after obtaining the opinion of the competent central council of the national pharmacists’ association. The competent council is notified by any means that provides a date certain for receipt of the referral. If the national order of pharmacists has not given its opinion within three months of the date of receipt of the referral, the Director General of the regional health agency may take a decision.
The Director General of the Regional Health Agency will decide on the application for authorisation in the light of, on the one hand, the needs of the structure and the resources available to the internal-use pharmacy, in accordance with the provisions of article R. 5126-8 and, on the other hand, taking into account the supply of health services and the needs of the region, in accordance with the provisions of article L. 1431-2.
II. -The authorisation specifies:
1° The location or locations of the pharmacy’s premises;
2° The various locations of the establishments, services or organisations served by the pharmacy and, where applicable, the geographical area in which holders of home hospitalisation authorisations or home dialysis units operate;
3° The tasks and activities mentioned in articles R. 5126-9 and R. 5126-10, carried out by the internal-use pharmacy on its own behalf or on behalf of another internal-use pharmacy and, where appropriate, the pharmaceutical form, nature of the products or operations in the case of the activities provided for in 2°, 3° and 7° of I of article R. 5126-9.
4° The tasks or activities carried out by another internal-use pharmacy on behalf of the internal-use pharmacy;
5° The time spent by the pharmacist in charge of management, expressed in weekly half-days;
6° Where applicable, the duration of the authorisation for the tasks mentioned in I of article L 5126-8, in compliance with the provisions of article R 5126-35.
