Article R5126-49 of the French Public Health Code

The management of an internal use pharmacy belonging to a private person is carried out by an employed pharmacist who, having fulfilled the conditions for practising pharmacy required by articles R. 5126-2 and R. 5126-7, is bound to the establishment by a management contract.

This contract may include specific clauses for the management of the pharmacies of holders of authorisations for home hospitalisation activities and home dialysis units.

Pharmacists covered by the provisions of article L. 4138-2 of the Defence Code who are made available by the Minister of Defence may also manage these pharmacies under the conditions laid down in their statutes.

La gérance d’une pharmacie à usage intérieur relevant d’une personne privée est assurée par un pharmacien salarié qui, remplissant les conditions d’exercice de la pharmacie requises par les articles R. 5126-2 et R. 5126-7, est lié à l’établissement par un contrat de gérance.


Ce contrat peut comporter des clauses spécifiques pour la gérance des pharmacies des titulaires d’autorisation d’activité d’hospitalisation à domicile et des unités de dialyse à domicile.


Les pharmaciens relevant des dispositions de l’article L. 4138-2 du code de la défense mis à disposition par le ministre de la défense peuvent également assurer cette gérance dans les conditions prévues par leur statut.
