Article R5134-4-1 of the French Public Health Code

In order to allow contraceptive treatment to continue when all the contraceptives prescribed have been dispensed, the pharmacist may dispense, for a period not exceeding six months, the oral contraceptives mentioned on the prescription, if :

1° The contraceptive in question is not on the list referred to in the second paragraph of article L. 5125-23-1;

2° The prescription is less than one year old.

The additional dispensing period carried out by the pharmacist either on renewal of the prescription by the nurse pursuant to article L. 4311-1, or on his own initiative under this article, or cumulatively by both, may not exceed a total of six months.

Article R5134-4-1

Afin de permettre la poursuite d’un traitement contraceptif lorsque la totalité des contraceptifs prescrits a été délivrée, le pharmacien peut dispenser, pour une durée qui ne peut excéder six mois, les contraceptifs oraux mentionnés sur l’ordonnance, si :

1° Le contraceptif visé ne figure pas sur la liste mentionnée au deuxième alinéa de l’article L. 5125-23-1 ;

2° L’ordonnance date de moins d’un an.

La durée de dispensation supplémentaire réalisée par le pharmacien soit sur renouvellement de la prescription par l’infirmier en vertu de l’article L. 4311-1, soit sur son initiative dans le cadre du présent article, soit cumulativement par l’un et l’autre, ne peut excéder au total six mois.
