Article R518-60 of the French Monetary and Financial Code

Authorised associations and foundations are subject to the following obligations:

1° Include in their objects lending for the creation and development of businesses and lending for the implementation of social integration projects by individuals, in accordance with the authorisation given to them pursuant to article R. 518-58;

2° Set up an internal control system for their lending activities, which must include rules for selecting and monitoring risks, separation of decision-making and control functions, signature by a duly authorised person for the granting of loans, appointment of a person responsible for internal control and indicators for monitoring the results of the activity;

3° Have their annual accounts certified by an auditor.

Article R518-60

Les associations et les fondations habilitées sont soumises aux obligations suivantes :

1° Inclure dans leur objet statutaire l’activité de prêt pour la création et le développement d’entreprises et celle de prêts pour la réalisation de projets d’insertion par des personnes physiques, en fonction de l’habilitation qui leur a été donnée en application de l’article R. 518-58 ;

2° Mettre en place, dans le cadre de leur activité de prêt, un contrôle interne qui doit prévoir notamment les règles de sélection et de surveillance des risques, la séparation des fonctions de décision et de contrôle, la signature par une personne dûment habilitée pour l’octroi des prêts, la désignation d’un responsable du contrôle interne et les indicateurs de suivi des résultats de l’activité ;

3° Faire certifier leurs comptes annuels par un commissaire aux comptes.
