Article R519-40 of the French Monetary and Financial Code

The association verifies that its members and the staff concerned comply with the obligations relating to training and continuing professional development set out in articles L. 314-24 and R. 519-15-1.

It verifies that the training courses referred to in article R. 519-15-1 are:

1° Effectively provided as part of internal offers or offers from external bodies relating to the training courses referred to inarticle L. 6313-1 of the Labour Code, the association acting in this respect in compliance with the rules for preventing conflicts of interest referred to in article R. 519-50;

2° Adapted to the nature of the products distributed, the distribution methods used and the functions performed.

To this end, each member shall provide the Association each year with a list of the names of the staff concerned, specifying the position held and the number of hours and subjects of training attended. They shall provide the Association with any evidence of compliance with the above-mentioned training requirements, in particular job descriptions and training certificates.

L’association vérifie le respect par ses membres et leur personnel concerné des obligations de formation et de développement professionnels continus prévues aux articles L. 314-24 et R. 519-15-1.


Elle vérifie que les formations mentionnées à l’article R. 519-15-1 sont :


1° Effectivement dispensées dans le cadre d’offres internes ou d’offres d’organismes externes portant sur des actions de formation mentionnées à l’article L. 6313-1 du code du travail, l’association agissant à cet égard dans le respect des règles de prévention des conflits d’intérêts mentionnées à l’article R. 519-50 ;


2° Adaptées à la nature des produits distribués, aux modes de distribution auxquels ils ont recours et aux fonctions exercées.


A cette fin, tout membre fournit chaque année à l’association une liste nominative du personnel concerné précisant le poste occupé ainsi que le nombre d’heures et les thèmes des formations suivies. Il tient à disposition de l’association tout élément justifiant du respect des exigences de formation susmentionnées, notamment les fiches de postes et les attestations de formation.
