Article R5212-7 of the French General Code of Local Authorities

The State representative who refers the matter to the regional audit chamber in accordance with article L. 5212-25 attaches to this referral the commune’s request, the decision of the trade union committee which motivated this request, the trade union’s articles of association and the latest administrative accounts and budgets of the local authority and establishment.

The chamber issues a reasoned opinion in which it rules on the admissibility of the referral and proposes to the State representative a new method for distributing the financial contributions to the syndicate’s budget.

This opinion is notified to the State representative, the inter-communal syndicate and the communes concerned.

The State representative sends the chamber a copy of its decision adopting the method for distributing the communal contributions.

Le représentant de l’Etat qui saisit la chambre régionale des comptes conformément à l’article L. 5212-25 joint à cette saisine la demande de la commune, la décision du comité syndical qui a motivé cette demande, les statuts du syndicat ainsi que les derniers comptes administratifs et budgets de la collectivité et de l’établissement.

La chambre rend un avis motivé dans lequel elle se prononce sur la recevabilité de la saisine et propose au représentant de l’Etat une nouvelle modalité de répartition des contributions financières au budget du syndicat.

Cet avis est notifié au représentant de l’Etat, au syndicat intercommunal et aux communes intéressées.

Le représentant de l’Etat transmet à la chambre copie de sa décision arrêtant la modalité de répartition des contributions communales.
