Article R53-8-26 of the French Code of Criminal Procedure

In application of Article 706-53-8, the file manager sends daily notices to the Ministry of the Interior of new entries, changes of address relating to an entry or failure to provide proof of address.

It notifies the department managing the wanted persons file daily of the deletions it has made pursuant to the articles 706-53-4 and 706-53-10.

Drawn up after automated consultation of the national file of incarcerated persons, the notice referred to in the first paragraph above specifies, if applicable, the name of the establishment where the person concerned is being held, the address declared on release and the foreseeable date of release.

The department managing the file is authorised to implement automated consultation of the national file of incarcerated persons for the purposes of the file as defined in the preceding paragraphs.

En application de l’article 706-53-8, le gestionnaire du fichier adresse quotidiennement au ministère de l’intérieur les avis relatifs aux nouvelles inscriptions, aux modifications d’adresse relatives à une inscription ou aux défauts de justification d’adresse.

Il avise quotidiennement le service gestionnaire du fichier des personnes recherchées des effacements auxquels il a procédé en application des articles 706-53-4 et 706-53-10.

Etabli après consultation automatisée du fichier national des personnes incarcérées, l’avis visé au premier alinéa précédent précise, s’il y a lieu, le nom de l’établissement où la personne intéressée est détenue, l’adresse déclarée à la sortie et la date prévisible de sa libération.

Le service gestionnaire du fichier est habilité à mettre en oeuvre la consultation automatisée du fichier national des personnes incarcérées pour les besoins du fichier tels que définis aux alinéas précédents.
