Article R5315-8 of the French Labour Code

The Managing Director is appointed by decree on the joint proposal of the supervisory ministers.

The Director General:

1° Prepares, co-signs and executes the contract of objectives and performance provided for in 1° of Article R. 5315-3;

2° Prepares the deliberations of the Board of Directors and ensures their execution;

3° Prepares and executes the institution’s budget;

4° Is the authorising officer for revenue and expenditure;

5° Has authority over all the institution’s staff and ensures their management. In this capacity, it recruits, appoints and manages staff;

6° Chairs the central social and economic committee;

7° Concludes agreements and contracts relating to the institution’s missions within the limits set by the Board of Directors;

8° Represents the institution in legal proceedings and in civil acts under the conditions set by the Board of Directors in application of 20° of article R. 5315-3;

9° Draws up the annual activity report and the corporate report;

10° Reports on its management to the Board of Directors.

It may delegate its signature to staff under its authority.

Le directeur général est nommé par décret sur proposition conjointe des ministres de tutelle.


Le directeur général :


1° Prépare, cosigne et exécute le contrat d’objectifs et de performance prévu au 1° de l’article R. 5315-3 ;


2° Prépare les délibérations du conseil d’administration et en assure l’exécution ;


3° Prépare et exécute le budget de l’établissement ;


4° Est ordonnateur des recettes et des dépenses ;


5° A autorité sur l’ensemble des personnels de l’établissement et en assure la gestion. A ce titre, il recrute, nomme et gère le personnel ;


6° Préside le comité social et économique central ;


7° Conclut les conventions et marchés se rapportant aux missions de l’établissement dans les limites fixées par le conseil d’administration ;


8° Représente l’établissement en justice et dans les actes de la vie civile dans les conditions prévues par le conseil d’administration en application du 20° de l’article R. 5315-3 ;


9° Etablit le rapport annuel d’activité ainsi que le rapport social ;


10° Rend compte de sa gestion au conseil d’administration.


Il peut déléguer sa signature aux personnels placés sous son autorité.
