I. – On receipt of an application, the Autorité de contrôle prudentiel et de résolution shall check that it includes all the information required under the terms of I or II ofArticle R. 532-1 , as applicable, and, if so, shall examine it. If not, it will ask the applicant to provide the missing information.
The Autorité de contrôle prudentiel et de résolution shall forward the application to the Autorité des marchés financiers within five working days of the date of receipt of a complete application.
II. – The Autorité des marchés financiers will notify the applicant of its decision on the programme of operations and inform the Autorité de contrôle prudentiel et de résolution within three months of receipt of the application by the Autorité des marchés financiers. If the Autorité des marchés financiers does not respond within this period, the application is deemed to have been rejected.
III. – The Autorité de contrôle prudentiel et de résolution shall decide on applications for authorisation as an investment firm within six months of receipt of a complete application. It shall decide on applications from credit institutions for authorisation to provide investment services within the time limits stipulated in I ofArticle R. 511-2-1. If the Autorité de contrôle prudentiel et de résolution remains silent after these deadlines, the application is deemed to have been rejected.
IV. – The Autorité de contrôle prudentiel et de résolution, on its own initiative or at the request of the Autorité des marchés financiers, may ask the applicant for any additional information needed to examine the case.
