Article R532-35 of the French Monetary and Financial Code

Pursuant to Article V of Article L. 532-39, in the event of a difference of opinion between the Autorité des marchés financiers and the European Securities and Markets Authority :

1° The Autorité des marchés financiers shall inform the European Securities and Markets Authority in a reasoned decision ;

2° Where the AIFM markets units or shares of AIFs that it manages in Member States other than France, the AMF shall inform the competent authorities of these other Member States of the discrepancy in a reasoned decision. Where applicable, it shall also inform the competent authorities of the home Member States of the AIF managed by the AIFM, by means of a reasoned decision.

En application du V de l’article L. 532-39, en cas d’appréciation divergente entre l’Autorité des marchés financiers et l’Autorité européenne des marchés financiers :

1° L’Autorité des marchés financiers informe l’Autorité européenne des marchés financiers par décision motivée ;

2° Lorsque le gestionnaire commercialise des parts ou des actions de FIA qu’il gère dans des Etats membres autres que la France, l’Autorité des marchés financiers informe de cette divergence les autorités compétentes de ces autres Etats membres par décision motivée. Le cas échéant, elle en informe également, par décision motivée, les autorités compétentes des Etats membres d’origine des FIA gérés par ce gestionnaire.
