The Director General of the Agency for the Management and Recovery of Seized and Confiscated Assets is a judge appointed by order of the Minister of Justice for a renewable term of three years.
He is assisted by a secretary general appointed by order of the budget minister.
The Director General, assisted by the Secretary General, is responsible for the management and general conduct of the agency. He represents it in legal proceedings and in all civil acts. He is the authorising officer for the agency’s revenue and expenditure. He recruits the staff under his authority. He shall enter into the acts, contracts or markets and conclude the transactions necessary for the smooth running of the agency, subject to the powers conferred on the Board of Directors by Article R. 54-3.
It prepares the meetings of the Board of Directors, draws up the public institution’s budget and implements the Board’s decisions. At each meeting, he reports to the Board on the agency’s activities and the decisions taken on the basis of the delegations he has received.
He may delegate some of his duties to the agency’s secretary general.
He may delegate his signature to any member of staff of the public establishment exercising managerial functions.
He may appoint secondary authorising officers.
