Article R5437-2 of the French Public Health Code

Legal entities declared criminally liable, under the conditions set out inarticle 121-2 of the French Criminal Code, for the offences defined in article R. 5437-1 shall be liable, in addition to a fine in accordance with the terms and conditions set out inarticle 131-41 of the French Criminal Code, to the confiscation of the thing that was used or intended to be used to commit the offence.

Article R5437-2

Les personnes morales déclarées responsables pénalement, dans les conditions prévues par l’article 121-2 du code pénal, des infractions définies à l’article R. 5437-1 encourent, outre l’amende suivant les modalités prévues par l’article 131-41 du code pénal, la peine de confiscation de la chose qui a servi ou était destinée à commettre l’infraction.
